1. Introduction and Acceptance

Welcome to Pride The Hague. These Terms and Conditions ("Terms") govern your use of our website, mobile application, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our Services.

2. Definitions

  • "We," "Us," "Our": Refers to Pride The Hague / Pride Workgroup at COC Haaglanden
  • "You," "User": Refers to any individual or entity using our Services
  • "Content": All text, images, videos, data, and other materials on our Services
  • "Event": Any activity, program, or gathering organized as part of Pride Week
  • "User Content": Content submitted, uploaded, or shared by users

3. Eligibility

To use our Services, you must:

  • Be at least 16 years old (or have parental/guardian consent)
  • Have the legal capacity to enter into these Terms
  • Not be prohibited from using the Services under applicable law
  • Provide accurate and complete information when registering

Some events may have additional age restrictions, which will be clearly indicated.

4. User Accounts and Registration

4.1 Account Creation

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as necessary
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account

4.2 Account Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Harm the community or other users
  • Remain inactive for extended periods

5. Use of Services

5.1 Permitted Use

You may use our Services to:

  • Browse Pride Week events and activities
  • Register for events and programs
  • RSVP and manage your event attendance
  • Collect digital badges and achievements
  • Connect with the LGBTQIA+ community
  • Share your story (with consent)
  • Receive Pride Week updates and news

5.2 Prohibited Conduct

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Post discriminatory, hateful, or offensive content
  • Harass, threaten, or harm other users
  • Impersonate others or misrepresent your identity
  • Collect user data without consent
  • Distribute spam, malware, or viruses
  • Attempt to gain unauthorized access to our systems
  • Use automated tools (bots, scrapers) without permission
  • Interfere with the proper functioning of the Services
  • Resell or commercialize the Services without authorization

6. Event Registration and Tickets

6.1 Registration

When registering for events:

  • RSVPs and registrations are subject to availability
  • Confirmation does not guarantee entry if capacity is reached
  • You must comply with event-specific rules and requirements
  • Accessibility accommodations should be requested in advance

6.2 Partner Events and Payment Processing

Many events listed on Pride The Hague are organized by partner organizations, venues, or third parties:

  • Partner events may require payment or ticketing through external platforms
  • All payment processing for partner events is handled exclusively by those partners
  • Pride The Hague does not process payments, store payment information, or receive any financial data from partner event transactions
  • Partner organizations are solely responsible for their own payment processing, refund policies, and ticketing systems
  • Prices are set by event organizers and are typically in Euros (EUR) unless stated otherwise
  • We are not responsible for third-party payment processors, ticketing fees, or any issues arising from external payment systems

6.3 Cancellations and Refunds

Refund eligibility depends on:

  • The specific event's cancellation policy
  • How far in advance you cancel
  • Whether the event is canceled or postponed by organizers

If an event is canceled by Pride The Hague, you will be entitled to a full refund or credit toward another event.

7. Content and Intellectual Property

7.1 Our Content

All Content on our Services, including but not limited to:

  • Text, graphics, logos, and images
  • Software, code, and functionality
  • Pride The Hague branding and trademarks
  • Event descriptions and materials

is owned by Pride The Hague or our licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 User Content

When you submit content (stories, photos, comments), you:

  • Retain ownership of your content
  • Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for Pride The Hague purposes
  • Confirm you have all necessary rights to share the content
  • Agree your content does not violate third-party rights

7.3 Photography and Recording

By attending Pride events, you acknowledge that:

  • Photos and videos may be taken at events
  • You may appear in promotional materials
  • You can opt-out by contacting us or wearing an "opt-out" indicator provided at events

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms. Privacy Policy

By using our Services, you consent to the processing of your data as described in the Privacy Policy.

9. Community Standards and Conduct

Pride The Hague is committed to creating a safe, inclusive, and welcoming environment. We expect all users and participants to:

  • Respect the diversity of our community
  • Use inclusive language and pronouns when known
  • Report safety concerns or violations immediately
  • Support and uplift marginalized voices
  • Create an environment free from discrimination and harassment

Zero Tolerance Policy: We have zero tolerance for discrimination, harassment, hate speech, or violence based on sexual orientation, gender identity, race, ethnicity, religion, disability, or any other protected characteristic.

10. Event Attendance and Assumption of Risk

By entering an event venue or attending any event that is part of Pride The Hague, you accept the conditions and risks described below. This applies to all events listed on our website, whether organised by us or by third parties.

10.1 Attendance at own risk

Entering the event grounds and attending events is at the visitor's own risk. This does not affect the organiser's statutory duty of care under Article 6:162 of the Dutch Civil Code (tort law) and the supplementary effect of reasonableness and fairness under Article 6:248 DCC.

  • You are responsible for your personal belongings. We accept no liability for loss, theft, or damage to personal property.
  • Sound levels at music events may be high. We recommend wearing hearing protection. We are not liable for hearing damage.
  • Outdoor events (including the Pride Walk) are subject to weather conditions. We are not liable for damage caused by weather, temperature, or natural conditions.
  • You must assess for yourself whether your health allows attendance at events. If in doubt, consult your doctor.

10.2 Third-party events

The majority of events listed on our website are organised by independent third parties (organisers, venues, associations, businesses). Pride The Hague, COC Haaglanden, the Municipality of The Hague, and their respective board members, staff, and volunteers are not the organiser of these events and are not liable for:

  • The quality, safety, or content of third-party events
  • The acts or omissions of external organisers, their staff, or other attendees
  • Personal injury, property damage, or other loss arising from attending third-party events
  • Cancellation, modification, or relocation of events by external organisers
  • Payments to or transactions with external organisers

Third-party events are subject to the terms and conditions of the respective organiser. We recommend reviewing these beforehand.

10.3 Safety and conduct

While we take reasonable measures to ensure safety during events we organise, complete safety can never be guaranteed. This is in line with the duty of care as described in Article 6:162 of the Dutch Civil Code.

  • You must follow instructions from the organisation, security, and emergency services
  • Report suspicious situations immediately to the organisation or security
  • Familiarise yourself with emergency exits and first aid stations on arrival
  • The organisation reserves the right to refuse entry or remove persons

10.4 Photography and recordings

During events, photographs, videos, and audio recordings may be made by the organisation, partners, media, and other attendees. By attending an event, you agree that you may be visible in such material, which may be used for promotion, social media, and reporting. If you do not wish to be photographed, you may inform the organisation or photographer. We also refer to our portrait rights policy in accordance with the Dutch Copyright Act (Articles 19-21 Aw) and the GDPR.

10.5 Pride Walk (Demonstration/March)

The Pride Walk is a demonstration within the meaning of Article 9 of the Dutch Constitution and the Public Manifestations Act (WOM). Participation in the Pride Walk is at your own risk. The route is coordinated in advance with the Municipality of The Hague and the police. The organisation has a notification obligation, not a permit requirement (WOM Article 4).

By participating in the Pride Walk, you agree to the following:

  • You follow instructions from the organisation, route marshals, police, and emergency services at all times
  • You stay on the designated route and do not block emergency exits, side streets, or access for emergency services
  • Groups and organisations must register in advance. Individual participants may join freely without registration
  • You are personally liable for any damage you cause to third-party property, public space, or other participants
  • Bringing vehicles, bicycles, or other motorised means into the walking march is not permitted unless approved by the organisation in advance
  • Sound systems and amplified music are only permitted with prior approval from the organisation

Respect for the city:

  • We expect all participants to treat the city of The Hague, its residents, buildings, and public space with respect
  • Participants are responsible for cleaning up their own waste. Leave the route cleaner than you found it
  • Damaging or climbing on street furniture, monuments, traffic signs, or third-party property is prohibited
  • Public urination is prohibited and may be fined by the municipality (The Hague Municipal Bye-laws)
  • We are guests in public space. Treat the city with care and pride

The organisation accepts no liability for injury, damage, or loss of property during the Pride Walk, to the extent this is not the result of intent or gross negligence by the organisation. Participants who cause damage to third parties or public space are personally liable (Article 6:162 DCC). This does not affect the right to demonstrate under Article 9 of the Dutch Constitution.

11. Disclaimers and Limitations of Liability

11.1 Website and information

Information on this website, including but not limited to event details, dates, times, locations, descriptions, and prices, is provided in good faith but may contain inaccuracies or outdated information. We do not guarantee that all information is complete, current, or error-free at all times. Event information is partly processed automatically (including through AI translations) and may differ from reality.

  • Always verify information with the organiser of the relevant event
  • We are not liable for damage resulting from incorrect or incomplete information on our website
  • Events may be changed or cancelled without prior notice

11.2 Exclusion of parties

The following parties are, to the extent permitted by law, not liable for any direct, indirect, incidental, special, or consequential damages in connection with Pride The Hague, the website, or events:

  • Stichting COC Haaglanden and its board members, staff, and volunteers
  • The Pride The Hague working group and its members
  • The Municipality of The Hague
  • Sponsors, partners, and supporting organisations
  • External event organisers and their staff
  • Venues and location owners

This limitation of liability applies in accordance with Article 6:233(a) DCC and Article 6:237(f) DCC. This limitation does not apply in cases of intent or deliberate recklessness by the relevant party, nor in cases where mandatory law does not permit limitation of liability.

11.3 Maximum liability

If Pride The Hague or COC Haaglanden is held liable despite the foregoing, total liability is limited to the amount paid out by the liability insurance in the relevant case, or, failing that, to a maximum of EUR 500. This is without prejudice to statutory rights that cannot be contractually limited under Dutch mandatory law.

11.4 Force Majeure

We are not liable for failure to meet our obligations if this is the result of force majeure within the meaning of Article 6:75 DCC, including but not limited to: extreme weather conditions, pandemics, government measures, strikes, power outages, communication system failures, or other circumstances beyond our reasonable control.

11.5 Limitation period

Claims under these terms are time-barred one (1) year after the claim arises, unless mandatory law prescribes a longer period (Article 3:310 DCC).

12. House Rules and Code of Conduct

The following rules apply at all events that are part of Pride The Hague, in accordance with house rules customary at Dutch events (VSCD model). By entering an event venue, you accept these rules.

12.1 Prohibited items and conduct

  • It is prohibited to bring weapons, drugs, glassware, fireworks, or other dangerous items to events (Dutch Weapons and Ammunition Act, Opium Act)
  • The use of (soft and hard) drugs on event grounds is prohibited
  • Discrimination, racism, homophobia, transphobia, and any form of hate or violence are not tolerated (Articles 137c-137e Dutch Criminal Code)
  • Sexual harassment and unwanted physical contact are prohibited
  • Obstructing or insulting other visitors, staff, or artists is prohibited
  • Smoking is only permitted in designated areas (Dutch Tobacco Act)

12.2 Alcohol and minors

  • It is prohibited to sell or serve alcohol to persons under 18 (Dutch Licensing and Catering Act)
  • Visitors may be asked to present valid identification for alcohol purchases
  • Some events have a minimum age requirement. Check the event information beforehand
  • Persons who are clearly intoxicated may be denied entry

12.3 Access and removal

The organisation reserves the right to deny entry or remove visitors who do not comply with the house rules, code of conduct, or instructions from staff/security, without refund of admission fees. This is without prejudice to the organisation's right to file a report with the police.

12.4 Searching and bag checks

At certain events, security staff may check bags and clothing as a condition of entry. By entering the event grounds, you consent to these checks. Refusal may result in denial of entry.

13. Volunteers

Volunteers who register through our website or assist on location do so at their own risk and without an employment contract. There is no employment relationship with COC Haaglanden or Pride The Hague. Volunteers are covered by the Municipality of The Hague's volunteer insurance where applicable. Volunteers must follow the organisation's instructions and are bound by the same code of conduct as visitors.

14. Indemnification

You agree to indemnify, defend, and hold harmless Pride The Hague, its officers, volunteers, partners, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your User Content
  • Your conduct at events

15. Modifications to Terms and Services

15.1 Terms Updates

We may modify these Terms at any time. Material changes will be communicated via:

  • Email notification (if you have an account)
  • Prominent notice on our website
  • Updated "Last Modified" date

Continued use of the Services after changes constitutes acceptance of the new Terms.

15.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of The Hague, Netherlands.

EU residents may also have the right to file complaints with their local consumer protection authorities.

Before filing a legal claim, we encourage you to contact us to seek an informal resolution:

18. Severability and Entire Agreement

18.1 Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18.2 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Pride The Hague regarding the Services.
